The Site is owned by Giglio.com S.r.l. (“Giglio”), a prestigious Italian Company, in adhering to Italian law and in particular to the Court of Palermo.

“Entering this web site the User and Giglio agree that the laws and the regulations of the Italian State will enforce any questions pertinent to the use of the Site. The User and Giglio also agree to submit exclusively to the competent Court of Palermo for the questions above. Giglio does not guarantee in any way that material present on the Site can be appropriate or of possible use in other countries, and the access to those materials from places where the relative contents are illegal is expressly prohibited. Users who choose to enter this site from said locations, do so at their own risk, and are solely responsible to respect relative local laws.”

Users of  the Site, accept and agree to respect all the conditions included in this declaration. The access and the use of this Site is not allowed to Users that not accept these terms.

The access and the use of the Site are for personal use only.

Giglio publishes information on the Site in order to provide a service to Users, but declines every responsibility of the possibility of eventual technical inaccuracy and/or typographical errors. Once brought to attention, Giglio will execute correction as soon as possible.

Giglio reserves the right to make corrections and changes to the Site when necessary, without giving prior notice.

Giglio does not offer any guaranty that the information published on the Site, is in conformity with the laws of the User’s competent jurisdiction.

The Site is a protected site according to international Internet standards which, if used correctly, Users can be reassured not to encounter viruses. However, Giglio declines any responsibility from eventual problems, damages, viruses or risks that the User may incur during the misuse of the Site and declines any responsibility from eventual faulty operations of the web site due to the deactivation of “cookies” in the User’s browser.

Giglio reserves the right to modify the terms and the conditions contained in this legal note when it is necessary without giving prior notice.

Users must accept the terms and conditions of this legal notice, and must be sure to visit these pages periodically for updates, changes and corrections.

Items featured on the Site reflect the actual availability of the item in color and size.
Giglio reserves the right to re-confirm the availability of the merchandise, verify the transaction’s validity and check the Client’s record with GIGLIO.

Clients will be informed if for any reason the item ordered is not available or if the order cannot be processed as per the Client’s request.

Giglio reserves the right to decline an order in the event that our bank does not receive verification from the Client’s bank.

It is at the sole discretion of Giglio to reserve the right to decline, to process and/or to ship an order and/or offer service to anyone at any time. Any order or any service not processed, or refused or not shipped, will be refunded, if already paid.

The products on sale on the Site are destined to the “Final Customer”.

By “Final Customer”, Giglio intends person or persons who do not operate their own entrepreneurial nor professional activity that may include but not be limited to the re-sale of merchandise purchased at the Site.

Therefore, Giglio invites Users who may not be considered a “Final Customer” to refrain both from attempting to establish business relations with Giglio nor to use accounts of third parties to forward purchase orders relative to the merchandise on sale.

In regard to the commercial policy described above, Giglio reserves the right to not process orders from persons that are not the Final Customer and any other orders that are not in conformity with the said commercial policies.

Pease note that backorder facility is not available. Any order including item not available, will be cancelled and the Client promptly refunded.

All Clients who enter into a commercial relationship with Giglio by placing an order, MUST have the item delivered. If at any time, a Client refuses the delivery or requests a return to sender all extra shipments and any import fees will be deducted from any eventual reimbursement.

To place orders at the Site, Clients must:

• be 18 years or older.
• be eligible to enter legally binding contracts.
• be competent to enter legally binding contracts.
• have a valid POP e-mail address.
• have a valid Credit Card for authorization and payment, or a bank deposit, or a Paypal verified account.

Special Import Requirements for United States residents:
Clients in the United States must have a Social Security Number or NON US CITIZEN Import Number called a CPB - Customs Border Protection - assigned number to properly import goods and pay import fees to the US Government Custom’s Agency. All orders from the Site will be subject to import fees outside of the European Community and it is the sole responsibility of the Client to comply with import regulations and pay import fees.

If the package is not successfully delivered to the Client’s address as per the Site commercial agreement, the package may risk being sent back to Italy at the Client’s expense including any import fees that may be assessed upon re-entry to Italy. These fees will be deducted from any eventual reimbursement.

ORDERS

Clients place orders on line and provide Credit Card details to a protected online banking system provided by primary Italian Bank (Banca Nazionale del Lavoro).

Giglio’s Clients are guaranteed maximum Credit Card security as all transactions are processed by the our Bank.

Giglio customer care agents will never ask for nor accept credit card numbers and/or expiration dates

If there are sufficient funds and the account is a valid account, our Bank immediately confirms that the transaction has been authorized.

Authorized funds are simply “blocked” funds on the Client’s account. The funds are NOT debited.

Giglio has up to 30 calendar days to confirm the availability and status of the merchandise and request verification of the transaction by contacting the Client’s bank for approval of the charges before the authorized status is confirmed as a charge to the Credit Card.
After 30 days, the Transaction must be debited or cancelled.
Giglio charges Client’s Credit Cards ONLY when parcel is ready to shipment.

We remind first-time Clients that Giglio will request our Bank to contact the Client’s bank for approval of the charges. This verification process will delay immediate shipping.

Credit Cards will be debited in Euro, and thus, due to exchange rates, the final price will be calculated in the applicable exchange rate the day the Credit Card company processes the transaction.

We remind our Clients in Russia that due to Russian Custom’s procedures, Giglio accepts Bank Wire Transfer as the sole method of payment. Please contact customercare@giglio.com  for further information.

VAT EXEMPTION

Product prices published on the web site GIGLIO reflect the actual retail price of the goods. The local Italian VAT taxes are not included.

Orders shipped outside of the European Economic Community are exempt from Italian Valued Added Tax.

Please be reminded that shipments destined outside of the European Community are subject to import fees (DDU Deliver Duties Unpaid) based on the Client’s home country regulations. Payment of these DDU fees is the sole responsibility of the Client.

Shipments to the UNITED STATES - please note:

SHIPMENTS THAT DO NOT CLEAR CUSTOM’S SUCCESSFULLY IN THE CLIENT’S HOME COUNTRY DUE TO THE NON-COMPLIANCE OF IMPORT REGULATIONS RISK BEING RETURNED TO ITALY AT THE CLIENT’S EXPENSE. ALL RE-IMPORT FEES ASSESSED TO PACKAGES RETURNING TO ITALY AND THE COST OF THE RETURN SHIPMENT WILL BE DEDUCTED FROM ANY EVENTUAL REIMBURSEMENT.

  
SHIPMENTS

Giglio ships worldwide, only with prestigious courier UPS. Please note that couriers will not deliver to P.O. Boxes, or personal mailboxes.

Giglio can ship to alternative or 3rd party addresses, but in the same country of client. However, this always requires that you are a previous customer already.

We remind first–time Clients that Giglio will request that address delivery of first order must match with Client credit card billing address.

Unfortunately, we only ship to one address per order, so we cannot ship a single order to multiple addresses.

Giglio reserves the right not to ship packages to any address that it feel may be suspect.

As per laws regulating commerce and trade, all shipments are accompanied with an official invoice with the declared values of each item in Euro. Discounted items reflect discounted prices. It is illegal to declare lower values or the items as gifts as per international import regulations.

By default, product prices published on this Site are Italian VAT not included until you proceed to check-out with your order. The VAT are then calculated according to your shipping destination and itemized on the Order Summary page.

Please note that Italian VAT will only be applied to orders dispatched within the European Community. Order dispatched outside EU are exempt from Italian Valued Added Tax.

DDP (Delivery Duty Paid) - Inside European Community
Shipments in the European Economic Community calculate import duties, custom fees and local sales taxes within the price published on the web site.
There are no additional fees to pay upon delivery.

Orders are shipped from Giglio in Italy, from Monday to Friday from 9:00 a.m. to 5:30 p.m., local time. Orders placed from Friday evening until Monday morning will be processed on Monday morning. Orders for available merchandise, based on the confirmation of the availability of the merchandise and verification of the Bank Transaction, are shipped on the first weekday after order placement. Credit Cards are debited the date of shipment.

Shipment fees:

• EU Countries: Euro 21.50 Delivery within about 3 business days of shipment with UPS.
• European Countries extra EU : Euro 21.50 (+DDU) Delivery within about 3 business days of shipment with UPS
• Outside of Europe: Euro 50.00 Delivery within about 48 hours with UPS Express Service.

Shipments outside of the European Economic Community are exempt VAT (Italian Value Added Tax) BUT ARE SUBJECT TO IMPORT FEES. Payment of these DDU fees is the sole responsibility of the Client.

Giglio shipments are insured against theft and accidental damage at no additional cost to the Client. Once the shipment reaches the destination, the goods are no longer covered by the insurance.

Upon delivery, Clients are asked to inspect the box carefully BEFORE placing a signature for the receipt of the merchandise. Giglio boxes are carefully packaged in white strong paper box with official Giglio.com logotype printed on the side and official Giglio adhesive tape around the entire box.

For any reason, if the box looks tampered or the official adhesive tape is NOT intact, either sign for the package with reservations or refuse the package. In the event, that the box has been signed for with an unauthorized signature or there is evidence that the package has been tampered, be sure to open a claim immediately with the local UPS Office and contact Giglio at customercare@giglio.com .

If for any reason, an order from Giglio is not successfully delivered to the Client’s address as per the commercial agreement, the package risks being sent back to Italy at the Client’s expense including any import fees that may be assessed. These fees will be deducted from any eventual reimbursement.

RETURN POLICY

If, for any reason, Clients are not satisfied with the order, the unused item(s) can be returned within 10 days of delivery.

In order to facilitate the return of items, please read carefully and follow the official Giglio RETURN POLICY as stated here below:

• The original Giglio Return Tag must be attached to the item(s) with our original Black Security Cord. Return Tag and Black Security Cord must not be removed or cut in any way
• Clients must contact customercare@giglio.com with a written request to return the item(s) within 10 days from the date of delivery. The written request must include the Item Code Number(s) of the item(s) to be returned.
• Once the written request is received, Giglio  will send a written confirmation to the Client including the Return Authorization Number. Clients must fill the return tag with this R.A.N.
• The returned item(s) must be in the same condition in which it was originally sent and packaged in an orderly fashion. Please be aware that, if you want to return shoes, the shoe box is part of the designer product and we are unable to accept any return without the original designer box, or if the box has been damaged.
• The return of the unused item(s) must reach Giglio within 10 (ten) days of the written confirmation from customercare@giglio.com
• The Client is responsible for shipment of the returned item and any eventual import fees.
• In the case of defective merchandise, or an error in the order on the part of Giglio , Clients must follow the instructions above. Giglio  reserves the right to request photographic support for returns regarding defective merchandise before authorizing the return and the eventual charges for the shipment and import fees. Giglio  will ship Clients the returned corrected goods free of charge.

Giglio reserves the right to refuse unauthorized returns.

Giglio will NOT accept any items that have been worn, washed or altered for any reason.

Giglio reserves the right to INSPECT returned merchandise and assess re-stocking fees depending on the state of the returned merchandise.

Please handle items very carefully, because Giglio will NOT accept any items that have Return Tag and/or Black Security Cord removed or cut in any way

Please note that all sales are FINAL for ALL discounted items and are non-returnable.

Bathing suits, swim wear and intimate apparel are not returnable.

All authorized returned merchandise is subject to re-entry inspection which is at the sole discretion of Giglio and must meet all the requirements listed under the Return Policy.

If the authorized returned item(s) passes re-entry inspection, the Client will receive a confirmation of the return from customercare@giglio.com  and the refund, less the original shipping charges (and any re-stocking fees), will appear on the Client’s Credit Card (or Bank or Paypal) statement within two billing cycles. The billing cycles may differ from Credit Card to Credit Card.
