These Terms and Conditions, together with the information contained in the Customer Care and Shopping Online sections (Orders, Delivery information, Returns, and Privacy Policy) of this Website and mobile App (the Website being a reference to www.giglio.com and any of its sub-domains, and App being a reference to GIGLIO.COM, our official mobile device application available on Apple Store and Play Store) set out the legal terms that govern the access, use, and sale of products on GIGLIO.COM.

Please note that by using our platform, you accept to be bound by these Terms and Conditions. We recommend that you read these Terms and Conditions carefully and that you print and save a copy for your records. We reserve the right to amend these Terms and Conditions whenever we deem it necessary, without any notice, without prejudice to your right to exercise withdrawal from the contract already concluded. It will be your responsibility to check this page regularly, as they will immediately become binding once they’re published on the Website and the App.

We would like to assure you that the care of our Customers is our primary interest. Our Services are always carried out in the interest of our Customers, and our main objective is to obtain the highest possible degree of satisfaction.

Definitions

Certain words or phrases used on this page have a specific meaning and are often capitalized. Namely, when we use “we”, “us”, and “our,” we mean GIGLIO.COM or, where applicable, other third parties. When we use “you” or “your,” we mean our Customers, i.e,. any physical person who purchases products for purposes unrelated to their business or professional activity. When we use Website, we refer to www.giglio.com, any of its subdomains, and our official mobile device application, GIGLIO.COM. When we use Services, we refer to the sale of products and all the other ancillary services we provide (Customer Care and arranging the delivery of products). When we use “Boutiques” we mean any store that is affiliated with us and is part of our Community Store.

We are GIGLIO.COM S.p.A., a company registered in Italy, with registered office in 7, via Solferino, Milan, 20121. Our VAT number is 05654840825. Our Website, including any sub-domains or mobile device application, is subject to and regulated by Italian Law.

Our products

We only sell top-quality luxury products bought directly from the most prestigious Italian and international fashion houses or carefully selected boutiques. We and the boutiques of the Community Store are official resellers of every product and brand sold on this Website.

We attempt to be as accurate as possible in describing and depicting the products on our Website. We always make sure that the information contained on the Website is complete, accurate, updated, and error-free. If errors are detected and signaled, we make sure to correct them as soon as possible. However, we deny any responsibility for any inconsistencies as well as for inaccuracies you might find on our platforms.

Our website and mobile application

We make no warranty that the Website will always operate properly, with no interruptions or malfunctions caused by your Internet connection. We will not be liable for any loss, damage, or risk you might incur while using our Website, as well as for any malfunctions caused by the deactivation of Cookies in your browser, or for any viruses or bugs that could damage your computer or mobile device.

Governing law

Anything related to this Website, to our official mobile application, and your orders is governed and regulated by Italian Law.

Every time you place an order on our platforms, even if the order is not completed, you are agreeing to the use of your personal information for administrative and business purposes as well as any other condition listed in our Privacy Policy, in accordance with articolo 13 del D.Lgs n. 196/2003 (Art.13 of the Italian Legislative Decree no.196/2003).

If your place of residence is in Italy, the territorial jurisdiction is established by the Italian Codice del Consumo (Consumer Code). If your place of residence is somewhere else in Europe, The European Commission has set up a European online dispute resolution platform (ODR Platform) for businesses in connection with online contracts for services to be settled by customers out-of-court. We will make every effort to avoid content that could be harmful to human rights, people’s beliefs, and dignity in all its forms and expressions. However, we can’t guarantee that our content will always be appropriate or lawful in some countries. Therefore, accessing our content from countries where such content is illegal is strictly prohibited. Those who decide to use the Website regardless do so at their own risk and will be held responsible under their local jurisdiction.

Following EU regulation 428/2022, the items listed in GIGLIO.COM's catalog are not intended for the individuals or companies mentioned in the aforementioned regulation.

Orders

Please be aware that the minimum order value to place an order on the Website depends on your delivery country, as illustrated below:

  • Italy: €30
  • Europe EU: €50
  • Rest of the world: €80

By completing an order, you are entering into a contract with us. Please keep in mind that the contract will be officially formed when you receive an e-mail from us confirming the shipment of your items. If you don’t receive this e-mail within 15 days, your offer is to be considered rejected.

Returns and cancellations

You have the right to withdraw from the contract, without specifying the reasons, within 14 days from the reception of the items by you or a designated third party, different from the courier, per Articolo 49 comma 4 del D.Lgs n.21/2014 (Art.49(4) of the Italian Legislative Decree no. 21/2014)

To withdraw from the contract, you have to inform us of your decision via post, fax, or electronic mail. To make this process quicker and easier, we suggest you log into your account on our Website and communicate your decision to withdraw from the contract through the section “My Orders” in your account. In this case, you won’t have to send a letter or a fax.

To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires. We will confirm we have successfully received your withdrawal request.

Once your return request has been received and accepted, we will issue a refund to your original payment method - unless otherwise specified - within 14 days from the day you communicated your decision to withdraw from the contract. In any case, you won’t be required to pay any additional fees. We maintain the right to put your refund on hold until we have received the items you have returned and until we have verified that no item has been manipulated or damaged. Please remember that we will only refund the shipping costs if you return every item of your order. You will be liable only for any diminution in the value of the item resulting from any handling other than that necessary to establish the nature, characteristics, and functioning of the goods.

Legal Guarantee of Conformity

Please be advised that the legal guarantee of conformity is provided by the Italian Consumer Code (Articles 128 et seq.) and protects the Customer in the event of purchasing defective products, or products that do not correspond to the use declared by the seller or the use for which that type of good is generally intended.

In the case of a defective product, you have the right, at your discretion, to the repair or replacement of the defective goods by the seller, without any charges, unless the requested remedy is impossible or excessively burdensome compared to the other. If replacement or repair is not possible, you are still entitled to a price reduction or a refund, commensurate with the value of the goods, upon returning the defective product to the seller.

The legal guarantee lasts for two years from the delivery of the goods, and you must always present proof of purchase to make a claim.

In the event of a report of a lack of conformity, we will:

  • take the defective product to verify the existence or lack thereof of a lack of conformity. In particular, please note that for defects that appear within the first twelve months from the date of delivery of the product, the verification is always the responsibility of the seller, as it is presumed that they existed at the time of delivery. Subsequently, only if the defect or fault does not depend on a lack of conformity, the consumer may be asked to reimburse the reasonable and previously indicated cost incurred by the seller for the verification;
  • If a lack of conformity is found, repair or replace the goods within a reasonable time from the request and without any charges to you.

It is specified that any contractual guarantees, whether free or paid, offered by the manufacturer or the retailer, do not replace or limit the legal guarantee of conformity.

In the case of a defective or damaged item, we invite you to contact our Customer Service immediately and provide detailed information about the defect found and send photos. The team will examine your request and provide a solution to the problem as quickly as possible.

Special Import Requirements for United States Residents:

Clients in the United States must have a Social Security Number or a NON-US CITIZEN Import Number called CPB - Customs Border Protection - to import goods and pay import fees to the US Government Customs Agency. The process to obtain a CBP-assigned import number generally takes 10 business days. For more information please visit the US Customs Border Protection Official Site: http://www.cbp.gov/. Please keep in mind that all orders shipped outside of the European Union will be subject to import fees, and it is your responsibility to comply with import regulations and/or pay import fees.

Not delivered orders and/or rejected delivery by the Client for United States residents

If the package is not successfully delivered to your address as per the commercial agreement, the package may risk being sent back to Italy at your expense, including any import fees that may be assessed upon re-entry to Italy (the minimum fee is €35). Please be aware that these fees will be deducted from any refund.

Intellectual property rights

We are the owners of all intellectual property rights and the content present in the Website, subdomains, and in the official App GIGLIO.COM (such as logos, texts, images, videos, documents, HTML code, and any other type of content). All content is protected by national and international laws on intellectual property and copyright. All rights are reserved, and content can't be reproduced or distributed without our consent. It is strictly forbidden to use any image found on our Website, subdomain, or App unless authorized through written consent from GIGLIO.COM.
